Dani Alves' Legal Battle Continues as Prosecution Appeals Acquittal in Sexual Assault Case

The Spanish Prosecutor's Office has filed an appeal against the acquittal of former footballer Dani Alves, arguing that the ruling by the Catalonia High Court of Justice (TSJC) unjustly undermines the credibility of the victim in a sexual assault case. The appeal, directed to the Supreme Court, criticizes the TSJC's interpretation of biological evidence as 'cruel and arbitrary,' which led to Alves' acquittal in March.

At the heart of the prosecution's appeal is the contention that the TSJC misapplied scientific evidence regarding the presence of Alves' DNA in the victim's mouth. The prosecution asserts that the court's conclusion, which suggested the victim had performed oral sex on Alves, was based on a flawed interpretation of the evidence. The prosecution argues that the DNA could have been transferred through other means, such as kissing or sharing a drink, and that the court's decision to discredit the victim's testimony was unjust.

The appeal also highlights concerns over the court's handling of the victim's testimony, suggesting that the trauma experienced by the victim was not adequately considered. The prosecution's filing describes the ruling as a 'public humiliation' for the victim, who feared from the outset that she would not be believed. The prosecution is calling for the Supreme Court to either overturn the acquittal and convict Alves or to order a retrial with a different panel of judges.
