Castellón Court Dismisses Appeal by Gender Violence Suspect Following Sex Change

The Second Section of the Provincial Court of Castellón has dismissed an appeal by a suspected abuser who sought to avoid investigation by a court exclusively handling violence against women after changing his sex in the Civil Registry. The court's decision underscores concerns that the sex change may have been motivated by fraudulent intentions rather than a sincere identity transition.

In its ruling, the court highlighted that the individual had been in a relationship with the complainant for over a decade, fathered a child with her, and continued to be recognized as the child's father. The alleged abuses occurred prior to the sex change, and the suspect had previously been involved in other gender violence cases, indicating an awareness of the legal consequences and potential strategies to evade them.

The defense argued that their client, legally recognized as a woman since August 29, 2023, should have the case transferred to an Instruction Court. However, the Castellón Court rejected this request, pointing to the timing of the sex change and the suspect's history as evidence of possible fraudulent motives aimed at circumventing the legal process.
