Madrid Magistrate Files Defamation Claims Against Interior and Transport Ministers

Judge Juan Carlos Peinado, who is leading the investigation into Begoña Gómez, wife of Spanish Prime Minister Pedro Sánchez, has filed lawsuits against Interior Minister Fernando Grande-Marlaska and Transport Minister Óscar Puente for alleged violation of his right to honor. The magistrate from Madrid's Instruction Court 41 has initiated conciliation proceedings against both government officials following public criticisms they made about his handling of the high-profile case.

The legal action against Minister Marlaska stems from comments made during a July 4th interview on La Sexta television, where the Interior Minister stated that Peinado's judicial conduct fell "outside the bounds" of proper legal procedure and suggested the prime minister's wife was experiencing "defenselessness." The judge alleges that Marlaska accused him of "twisting the law" for purposes unrelated to justice and described his work as "the paradigm of what judicial instruction should not be."

In the case of Transport Minister Óscar Puente, the lawsuit references a July 30th interview where the official characterized Peinado's investigation as "a crude, miserable journey to nowhere" and suggested it represented a "textbook case of nullity." Puente further questioned the judge's impartiality and rigor, claiming the magistrate's "clear purpose" was to "enter the Moncloa palace and record the prime minister giving testimony in a criminal case," even if only as a witness.

The conciliation proceedings will proceed in different first instance courts, with neither minister required to attend personally—their legal representatives may appear instead. If no agreement is reached during these preliminary stages, Judge Peinado retains the option to pursue civil action to defend his honor rights or potentially initiate criminal proceedings for alleged insults and slander against the government officials.
