The complaint alleges that Gallardo, alongside former deputy María Cruz Rodríguez, engaged in a 'grotesque, unquestionable, crude, and indecent' maneuver to change the court that would judge him, thereby securing a more favorable legal position.
The controversy stems from a legal proceeding in which Gallardo and David Sánchez, the brother of the Spanish Prime Minister, were investigated by the Court of Instruction No. 3 in Badajoz. According to Manos Limpias, all individuals under investigation were ordinary citizens without any legal privileges until Gallardo allegedly orchestrated his appointment as a deputy to become 'aforado,' a status that grants him the right to be judged by the Superior Court of Justice of Extremadura (TSJEx) instead of the ordinary court.
Manos Limpias claims that Gallardo's actions represent a 'blatant abuse of the law' and procedural fraud, as he reportedly arranged for Rodríguez to resign her seat in exchange for a government position, thereby enabling his own appointment as a deputy. This move, according to the complaint, was made just 48 hours before the judge was set to proceed with the trial, raising questions about the timing and motives behind Gallardo's sudden political ascent.
The case has drawn significant attention, with other organizations like Liberum also challenging Gallardo's aforamiento, arguing it undermines the dignity of the parliamentary chamber. As the legal and political drama unfolds, the TSJEx faces mounting pressure to address these allegations of procedural manipulation and ensure the integrity of the judicial process in Extremadura.
