Clece Condemned for Deficient Care Leading to Resident's Death in Mojados

26-09-2025

The Provincial Court of Valladolid has confirmed the conviction against Spanish company Clece S.A. for providing deficient care to 82-year-old resident María Álamo, who died in 2016 from generalized sepsis caused by an infected sacral ulcer. The ruling upholds the decision originally made by the Court of First Instance No. 2 of Valladolid, establishing the company's responsibility for the inadequate medical attention that led to the elderly woman's death at the San Ramon and San Luis nursing home in Mojados.

The court ordered Clece, which manages the elderly care facility where the incident occurred, to pay €80,116 in compensation to Álamo's three children—Jesús, María Luisa, and Ángel Suárez Álamo—plus legal and moratory interest. The family was represented by attorney Santiago Díez from the Association El Defensor del Paciente, who successfully argued that the company failed to provide proper medical care, resulting in the fatal infection.

The case highlights systemic issues within the public healthcare administration, as the family faced years of delays in obtaining the autopsy report necessary to determine the exact cause of death. Beginning in 2017, the children filed numerous complaints with the University Clinical Hospital of Valladolid, the Health Management of Valladolid, and the Health Department of Castilla and León, citing the administration's failure to deliver the necropsy report and provide clear responses.

This prolonged legal battle, marked by what the family's representatives describe as abnormal functioning within the public health system, extended the family's distress for years while they sought essential clinical information. The confirmed conviction underscores ongoing concerns about elderly care standards and administrative accountability in Spain's healthcare system, particularly in privately managed facilities operating under public contracts.
