The court's decision, dated May 19 and announced by the High Court of Justice of Galicia (TSXG), underscores the lack of evidence that Judge Vázquez Taín actively engaged in commercial activities through the company.
In its ruling, the Supreme Court highlighted the absence of concrete proof that Judge Vázquez Taín participated in the day-to-day operations or management of Amarola Producciones, S.L. The court noted that merely holding shares in the company does not equate to engaging in commercial activities that would conflict with his judicial duties. This distinction was pivotal in the court's decision to annul the sanction, which was based on a serious infraction under Article 417.8 of the Organic Law of the Judiciary.
The judgment further elaborated that there was no indication Judge Vázquez Taín had any role in the administration of the company or in signing contracts with third parties. The court found the arguments presented by the CGPJ insufficient to demonstrate any real or effective involvement in commercial activities by the judge.
