Legal Victory for Judge Vázquez Taín as Supreme Court Annuls Sanction

The Supreme Court of Spain has overturned a ten-day suspension imposed on Judge José Antonio Vázquez Taín by the General Council of the Judiciary (CGPJ), marking a significant legal victory for the magistrate. The sanction was initially levied due to allegations of incompatibility between his judicial role and his 50% ownership stake in Amarola Producciones, S.L., a production company. The court's decision, dated May 19 and announced by the High Court of Justice of Galicia (TSXG), underscores the lack of evidence that Judge Vázquez Taín actively engaged in commercial activities through the company.

In its ruling, the Supreme Court highlighted the absence of concrete proof that Judge Vázquez Taín participated in the day-to-day operations or management of Amarola Producciones, S.L. The court noted that merely holding shares in the company does not equate to engaging in commercial activities that would conflict with his judicial duties. This distinction was pivotal in the court's decision to annul the sanction, which was based on a serious infraction under Article 417.8 of the Organic Law of the Judiciary.

The judgment further elaborated that there was no indication Judge Vázquez Taín had any role in the administration of the company or in signing contracts with third parties. The court found the arguments presented by the CGPJ insufficient to demonstrate any real or effective involvement in commercial activities by the judge. This lack of evidence was central to the Supreme Court's conclusion that the sanction was unjustified.

This ruling not only clears Judge Vázquez Taín of the allegations but also sets a precedent regarding the interpretation of judicial incompatibility in Spain. It emphasizes the need for clear and substantiated evidence of active participation in commercial ventures before sanctions can be imposed on judges for alleged incompatibilities. The decision has been welcomed by legal experts who see it as a reinforcement of judicial independence and the principle of presumption of innocence.
